The petitioners seek bail in a case registered for the offences punishable under sections 307, 302, 120-B/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioners are named in the F.I.R. along with 12 other accused persons and they are alleged to have made indiscriminate firing causing death of Vivek Singh, husband of the informant.
It is submitted that Vivek Singh got one fire arm injury on his head and other injury is lacerated wound on elbow. Similarly situated co-accused Sanjiv Singh has already been granted bail vide order passed in Criminal Misc. No. 25653 of
Patna High Court Cr.Misc. No.21426 of 2015 (4) dt.04-09-2015 2015 as only one fire arm injury was found and the death was on account of fire arm injury. The case of the petitioners stands on the same footing as that of Sanjiv Singh Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Naugachhia in connection with Bihpur P.S. Case No. 18 of 2015.
