2. The petitioner seeks regular bail in a case registered for the offence under Sections 419, 420 and 120B of the Indian Penal Code and under Section 66D of the I.T. Act.

3. As per the prosecution case, the petitioner along with other co-accused were arrested near the examination center.

4. One answer sheet was found from the petitioner. The examination was being conducted by the Central Selection Board for Constable Recruitment, Bihar and the petitioner and other criminals have been found involved in leaking the question and cheating.

5. Learned counsel for the petitioner has submitted that the mobile phone has been sent for F.S.L. examination and, therefore there is no evidence against the petitioner and he may

6. Learned A.P.P. has vehemently opposed the prayer for bail and has submitted that the petitioner is involved in leaking the question papers of the Central Selection Board for Constable Recruitment, Bihar.

7. I have considered the submissions of the parties.

8. The petitioner has been found near the examination center with the answer sheet of the examination when he had no business to be present near the examination center.

9. In these circumstances, I am not inclined to grant bail to the petitioner. This application is dismissed.

10. The court below is directed to expedite the trial of the petitioner.

11. The Superintendent of Police, Lakhisarai is directed to get the trial of the petitioner and other co-accused persons of the present case expedited.

12. Let a copy of this order be communicated to the Superintendent of Police, Lakhisarai through FAX for its compliance forthwith.
