====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 15-03-2023 Learned counsel for the petitioner submits that this
Patna High Court C.Misc. No.1784 of 2018(5) dt.15-03-2023 2/2 case may be disposed of with a liberty for filing the appropriate application before the Court below in accordance with law. He has further submitted that the case of the plaintiff is not progressing in the trial Court.
Accordingly, this Court may direct the trial Court to expedite the trial and disposed of the case.
In view of the submissions of learned counsel for the petitioner and in the interest of justice this Civil Miscellaneous Application is disposed of with a liberty aforesaid. The learned trial Court is directed to expedite the disposal of Partition Suit No. 221 of 2009 pending in the Court of learned Sub-Judge-I, Shahpur Patori, Samastipur. Both the parties are also directed to co-operate in the disposal of the said suit.
