JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 02.05.2013 on the accusation that one country made loaded pistol and one live cartridge were recovered from his conscious possession. No doubt, petitioner was earlier convicted in another case for the offence punishable under various sections of the Indian Penal Code but petitioner has already preferred appeal before the appellate court against the above stated judgment of conviction.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with

Patna High Court Cr.Misc. No.41186 of 2015 (2) dt.11-09-2015 2/2 two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, Rosera at Samastipur in connection with Hasanpur P.S.Case No. 53 of 2013 arising out of Cr. Appl. No. 91 of 2013.
