JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is languishing in custody since 27.11.2018 in connection with Koilwar P.S. Case No.461 of 2018 registered for the offences punishable under Section 354 (A) of the IPC and 8/12 of POCSO Act and 37(b) of the Bihar Prohibition & Excise Act, 2016.

Prosecution case is that on 26.11.2018, the petitioner started molesting to the daughter of the informant which neighbouring two ladies namely, Gyanti Devi and Punuta Devi saw and raised alarm upon which local people gathered and consequently the petitioner fled away from the occurrence. Learned counsel for the petitioner submits that petitioner is having a clean antecedent except in one case as assertion made in para 3 of the bail petition in which he is on

Patna High Court Cr.Misc. No.1805 of 2019(2) dt.15-01-2019 2/2 bail.

Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bhojpur at Ara in connection with Koilwar P.S. Case No.461 of 2018.
