====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 20-06-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code.
The informant alleges that he married his sister with Rohit Kumar Tanti who is posted as a Jail Constable at Samastipur. It is next alleged that the deceased was staying in a rented house at Samastipur along with her husband while the petitioners were staying at Khagaria. Learned counsel for the petitioners submits that

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that from perusal of the allegation as alleged in the FIR it would manifest that even allegation relating to demand of dowry is general and omnibus in nature, it further submitted that informant is not an eye witness to the occurrence and the petitioners were living separately even at the time of occurrence. It is next submitted that whenever such occurrence takes place the entire family members of the husband are implicated, it is next submitted petitioners will not abscond rather will cooperate in the investigation and will present themself as and when required by the investigating officer. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released
