The petitioner seeks bail in Sessions Trial No. 348 of 2018 arising out of Kursela P.S. Case No. 49 of 2018, instituted for the offence under Section(s) 376, 302 and 34 of the Indian Penal Code.
Counsel for the petitioner submits that only suspicion has been raised against the petitioner. It is alleged in the written report that daughter of the informant had gone to work in the maize field. The informant also went to the aforesaid land after one hour and found her daughter lying dead in semi naked condition. The informant has raised suspicion against the petitioner and one Mahendra Mandal on account of previous enmity.
Patna High Court Cr.Misc. No.4412 of 2019(3) dt.08-02-2019 2/2 Counsel for the petitioner submits that co-accused Mahendra Mandal has already been granted bail by this Court vide order dated 17.12.2018 passed in Cr. Misc. 66320 of 2018. Petitioner is in custody since 30.5.2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st-cum-Special Judge, Katihar, in connection with Sessions Trial No. 348 of 2018 arising out of Kursela P.S.
