JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-03-2019 The petitioner apprehends his arrest in connection with Barh P.S.Case No. 197 of 2018 registered under Sections 494 and 498A/34 of the Indian penal Code.

Allegation against the petitioner is of torturing the informant with respect to demand of dowry. It further appears that earlier also a case has been lodged against the petitioner. Submission of learned counsel for the petitioner is that he is ready to keep his wife, if the informant is ready to reside with him.

Heard learned APP also and learned counsel appearing on behalf of the informant, who has opposed the prayer of bail stating that earlier also a case has been lodged against him and he has been granted provisional bail in order to keep the

Patna High Court CR. MISC. No.85 of 2019(3) dt.05-03-2019 2/2 informant along with him but he has not taken her and as such provisional bail bond was cancelled hence he does not deserve anticipatory bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
