JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Malsalmi P.S. Case No. 289 of 2015, registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that son of the informant was shot fired by co-accused Pale Paswan. The petitioner is said to be present there at that time. Further submission is that petitioner is accused in Malsalami P.S. Case No. 146 of 2011, but he is on bail. The petitioner is in custody since 30.11.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on

Patna High Court Cr.Misc. No.13711 of 2016 (2) dt.21-04-2016 2/2 bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Patna City in connection with Malsalami P.S. Case No. 289 of 2015.
