JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 307, 302 of the Indian Penal Code and 27 of the Arms Act. The first information report itself reflects that it were F.I.R. named accused Satyam Singh and Balwant Singh who shot fire on the deceased and so far as petitioner is concerned, it is only alleged that he was also present on the place of occurrence having pistol in his hand and opened fire on the witness, Mithai Chouhan who luckily escaped unhurt. Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner is in jail custody

Patna High Court CR. MISC. No.443 of 2019(3) dt.15-03-2019 2/2 since 17.11.2018, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Muffasil) P.S. Case No. 229 of 2018.
