Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Hilsa P.S. Case No. 608 of 2018 for the offence under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a)/38 and 41 of the Bihar Prohibition and Excise Act, 2016. In the instant case, on the basis of secret information, 2826 litres foreign liquor was recovered from the PACCS Godown.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 18.11.2018. He further submits that the petitioner has no
Patna High Court Cr.Misc. No.634 of 2019(2) dt.17-01-2019 2/2 concern with the PACCS Godown or with the liquor, which was seized. He submits that the petitioner was not involved in the sale and purchase of wine and he has been made accused in the instant case only on the basis of suspicion that he was fleeing away from the PACCS Godown from where the liquor was seized.
Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of 6th Additional Sessions Judge-cum-Special Judge (Excise), Nalanda at Bihar Sharif in connection with Hilsa P.S.
