JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-01-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner.

The petitioner apprehends his arrest in connection with Bihpur (Bhavanipur O.P.) P.S. Case No. 229 of 2020, registered for the offences punishable under Sections 341, 323, 379, 504, 506, 34 of the Indian Penal Code.

As per allegation, three persons came to the informant when he was sitting on machan near middle School, Jaypur Chuhar Balha East and assaulted him. The informant identified only Kartik Singh the present petitioner amongst them. It is further alleged that they also took Rs. 34,000/- from the informant. Learned counsel for the petitioner has submitted that the present petitioner was driver on the tractor of the informant and when

No.14855 of 2021(2) dt.13-01-2022 2/2 he went to the house of the informant for demanding his wages the informant and his family members badly assaulted him and in this respect he has filed a complaint case No. 132 of 2020 in the Court of A.C.J.M., Naugachhiya. The copy of the complaint petition has been annexed with the record.

Considering the above-mentioned facts and circumstances, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Naugachhiya in connection with Bihpur (Bhavanipur O.P.) P.S. Case No. 229 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
