JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is accused in connection with S.T. No.88 of 2016 arising out of Sultanganj (Akbar Nagar) P.S.Case No.189 of 2004, registered under Sections 302, 120(B)/34 of the Indian Penal Code and section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R.. In course of investigation the name of the petitioner has surfaced in the confessional statement of co-accused, Pramod Yadav. Except the confessional statement there is nothing against the petitioner having hand in the present case. He further submits that the petitioner is in custody since 27.12.2015.

Case No.189 of 2004.
