Petitioner seeks bail in a case registered under sections 406, 409, 419, 420, 467, 468, 471, 120(B) of the Indian Penal Code.
According to the prosecution case petitioner being Panchayat Secretary misappropriated Rs. 308900/- of the Government which was meant for the purpose of distribution among the people under the scheme of Samajik Suraksha Pension. It has been submitted on behalf of the petitioner that petitioner is in custody since 10.03.2015. Charge sheet has been submitted in the present case. It has been further submitted that petitioner has been made accused due to mistake of fact and
Patna High Court Cr.Misc. No.21166 of 2015 (2) dt.13-07-2015 2/2 he is ready to deposit Rs. 50000/- in the court below which will be subject to the final disposal of the case.
On behalf of the State it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts, the petitioner is directed to deposit Rs. 50,000/- in the court below which shall be subject to the result of the final disposal of the case. With the aforesaid condition the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned S.D.J.M, Araria in Jokihat P.S.
