JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-02-2019 The learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the judgment of the Hon'ble Apex Court rendered in the case of Mukesh Kumar & Anr. vs. the State of Bihar & Ors., reported in (2017)5 SCC 387.

Per contra, the learned counsel for the respondents submits that the case of the petitioner would be examined by the respondent no. 4 i.e. the District Education Officer, Bhojpur at Ara and he would verify as to whether the case of the petitioner is covered by the aforesaid judgment rendered in the case of Mukesh Kumar & Anr. (supra) and in case it is found that the case of the petitioner herein is covered by the said judgment, similar relief would be given.

Patna High Court CWJC No.23725 of 2018(2) dt.04-02-2019 2/2 Having regard to the submissions made by the learned counsel for the parties, the respondent no. 4 is directed to examine the case of the petitioner within a period of eight weeks from today and take a final decision as to whether the case of the petitioner herein is covered by the judgment rendered in the case of Mukesh Kumar & Anr. (supra) and in case it is found that the case of the petitioner is covered by the aforesaid judgment, similar relief shall be granted to the petitioner herein within a period of four weeks thereafter.

The writ petition stands disposed off on the aforesaid terms.
