JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 20.1.2015 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case is that on 13.1.2015 the son of the informant went out of the house conveying the informant that he is going to take money from co accused Ashok Yadav. Subsequently, the beheaded dead body of the son of the informant was recovered from the forest when suspicion was raised against the petitioner, Ashok Yadav and Dharo Yadav of killing the victim.

It is submitted by the learned counsel for the petitioner that there was dispute between the parties with regard to fishery

Patna High Court Cr.Misc. No.22830 of 2015 (2) dt.13-07-2015 2/2 rights and there is no direct evidence collected during investigation. It is further submitted that the victim was a veteran criminal.

Considering the fact that the accusation is based on circumstantial evidence, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Jamui in connection with Sikandara P.S. Case No. 7 of 2015.
