2. The petitioner seeks bail in connection with Bikramganj P.S. Case No. 557 of 2024 dated 22.09.2024 registered for the offence punishable under Sections 103(1), 238(a) and 3(5) of Bhartiya Nyaya Sanhita and Sections 25(1B)a, 26, 27 and 35 of the Arms Act.
3. The prosecution case, in short, is that the husband of the informant has been murdered by husband's nephew, namely, Anand Kumar @ Badal, by a double barrel licensee gun of her father-in-law, namely, Radhika Raman Singh. After murder of her husband, Anand Kumar @ Badal fled away from his house and with the help of co-villagers namely, Pawan
Patna High Court CR. MISC. No.5026 of 2025(2) dt.21-02-2025 2/3 Kumar Singh @ Dhanu Singh and Syandan Suman @ Shyam Nandan Singh (petitioner) concealed the alleged gun.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that there is specific allegation against coaccused Anand Kumar @ Badal. The petitioner has no role in killing the husband of the informant. It is also submitted that a gun and cartridges which were allegedly used in occurrence has been recovered before the institution of the present case from Shiv temple of the village, which is a public place and any person can enter the said temple. The petitioner has no concern with the said gun which belongs to the father-in-law of the informant. It is also submitted that the petitioner is a co-villager of the informant. It is next submitted that similarly situated coaccused person namely, Pawan Kumar Singh has been granted bail vide order dated 05.02.2025 passed by a Co-ordinate Bench of this court in Criminal Miscellaneous No. 1667 of 2025. Lastly, it has been submitted that the petitioner is in custody since 22.09.2024, having no criminal antecedent and chargesheet has been submitted in the case.
5. Learned A.P.P for the State as well as learned counsel for the informant vehemently opposed the prayer for
Patna High Court CR. MISC. No.5026 of 2025(2) dt.21-02-2025 3/3 bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Rohtas at Sasaram in connection with Bikramganj P.S. Case No. 557 of 2024.
