The petitioner is languishing in custody since 15.10.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 302, 435, 332, 353, 333, 120B of the Indian Penal Code, 27 of the Arms Act, 3/4/5 of Explosive Substances Act, 10, 11, 13(i) (ii) of Prevention of Unlawful Activities Act and 17 of Criminal Law Amendment Act. It is alleged that in a cross firing six police personnel lost their lives. The name of the petitioner transpired while the extremists were addressing each other, consequently the petitioner has been named in the FIR.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.14597 of 2015 (02) dt.01-05-2015 2/2 petitioner that the petitioner filed Complaint Case No. 74 of 2005 against the then Officer-in-charge Bhola Nath Singh and the present informant also and consequently the petitioner has been roped in several cases by the police personnel and the investigation has already concluded and others have been granted bail vide Cr. Misc. Nos. 17215 of 2013, 44813 of 2013 and 10511 of 2013.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gaya in connection with Sessions Trial No. 33 of 2015 arising out of Dumaria P.S. Case No. 62 of 2012.

Since the petitioner is accused in six other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
