The prayer made in this application is for restoration of Test Case No. 9 of 2016 which has already been restored by earlier order passed in MJC No. 1992 of 2016. As such, this application is misconceived.

In the facts and circumstances, learned counsel for the petitioner has sought permission to withdraw this application with a liberty to take appropriate steps in accordance with law. Accordingly, this application is dismissed as
