The petitioner being the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 504, 323, 494,506 and 379 of the Indian Penal Code.

The basic accusation is of torture and performing second marriage.

The petitioner and the informant are present in the Court.

Counsel for the petitioner submits that the petitioner admits his marriage with the informant but since there was no issue with the informant the petitioner performed second marriage. However, petitioner is still ready to keep the informant

Patna High Court Cr.Misc. No.13975 of 2016 (6) dt.02-08-2016 2/2 as wife with full dignity and honour. Statement to that effect has been made in paragraph 8 of the petition, which reads as follows:- "That it is submitted that the petitioner is still ready to keep the informant with full dignity and honour, but she is no more interested with the association of this petitioner and her only intention is to get more and more money from the petitioner and his families."

Counsel for the informant submits that in view of the fact that the petitioner has performed second marriage, the informant is not ready to accept the offer of the petitioner.

Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Nawhatta P.S. Case No. 153 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Saharsa. Accordingly, this application is disposed of. (Dinesh Kumar Singh, J) DKS/- U T
