JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code.

Petitioner is not named in the first information report and the learned 3rd Additional Sessions Judge, Bhojpur, Ara has also not mentioned in his impugned order as to how the name of petitioner came in this case and why was he rejecting the prayer for bail of the petitioner. However, at para-13 of the petition, it has been pleaded on behalf of the petitioner that name of petitioner came in this case in confessional statement of co-accused, Jai Chand Mahto and except the aforesaid confessional statement, there is nothing against the petitioner. It is pointed out on behalf of

Patna High Court Cr.Misc. No.12924 of 2016 (2) dt.31-03-2016 2/2 the petitioner that co-accused, Jai Chand Mahto has already been granted privilege of bail by a co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Narayanpur P.S. Case No. 19 of 2015.
