The petitioner is apprehending arrest in connection with Imamganj P. S. Case No. 122 of 2019 for offences under Sections 341, 323, 324, 307, 379, 147, 149, 436 and 448 of the Indian Penal Code.

Allegation against the petitioner is that she was a member of mob of 40 persons involved in the incident. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The petitioner and the informant are agnate and there is land dispute between the parties. Referring to para nos. 8 and 9 of the application, learned counsel for the petitioner submits that there is series of of cases and due to previous enmity the petitioner has been made

Patna High Court CR. MISC. No.7138 of 2020(2) dt.29-02-2020 2/2 accused in the instant case. There is no specific overt act alleged against this petitioner.

Considering the fact that the petitioner is lady, the petitioner has no criminal antecedent and there is no specific overt act alleged against her, the Court is inclined to grant bail to her. Let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Gaya in connection with Imamganj P. S. Case No. 122 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P. C.
