JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 Petitioner apprehends his arrest in connection with Parwalpur P.S. Case No. 146 of 2018 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 15 litres of liquor from the motorcycle of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case, having no criminal antecedent and he is ready to abide by any condition that may be imposed on him.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this

No.1035 of 2019(2) dt.16-01-2019 2/2 order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VI-cum-Special Judge, Excise, Nalanda at Bihar Sharif, in connection with Parwalpur P.S. Case No. 146 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
