The petitioner apprehends his arrest in connection with Allouli P.S. Case no. 256 of 2018, registered under Section 323, 341, 504 and 498(A) of the Indian Penal Code and Section 3 / 4 of Dowry Prohibition Act.
Learned counsel for the petitioner and O.P. No.2 submits that on the joint prayer of the parties, the matter was referred to Mediation Centre, Patna High Court, Patna for settlement of dispute between the petitioner and O.P. No.2, who are husband and wife, where both parties resolved the dispute through the process of mediation under the memorandum of
Patna High Court CR. MISC. No.603 of 2019(3) dt.03-05-2019 2/2 agreement, which is the part of the Mediator's report dated 10.04.2019. Accordingly, the petitioner will pay Rs. Two Lakhs within two months and, thereafter, O.P. No.2 would withdraw the Complaint Case No. 724(C) of 2018 and both parties will file divorce case on mutual consent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Allouli P.S. Case No. 256 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
