JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47 (A) (F) of Excise Act. In huge quantity country made liquors are said to have been recovered from the house and hut of the petitioner for which petitioner is in jail custody since 12.02.2016. Learned counsel for the petitioner submits that although, petitioner was earlier made accused in a case but the said case had not been registered under the provisions of Excise Act and, therefore, petitioner happens to be first offender in respect of case of Excise Act.

Patna High Court Cr.Misc. No.14052 of 2016 (2) dt.05-04-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Prosecution Report Case No. C2A33 of 2016.
