====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 26-08-2016 Heard Mr. Bindhyachal Singh, learned Counsel, appearing on behalf of the petitioner, and Mr. Upendra Pratap Singh, Assistant Counsel to learned Standing Counsel No.4, appearing on behalf of the State-respondents. Having regard to the nature of relief, which has been sought for, the informant of the case, namely, Anil Kumar Mehta, needs to be added as a party.

Patna High Court Cr. WJC No.552 of 2016 (7) dt.26-08-2016 2/3 In view of the above and in the interest of justice, the informant, namely, Anil Kumar Mehta, is hereby added as respondent No.7. Heard also Mr. Yogesh Chandra Verma, learned Senior Counsel, appearing on behalf of the informant. Mr. Upendra Pratap Singh, learned counsel for the State-respondents, submits that further investigation, which has been started, would be concluded within a period of one week. In view of the above submission being made by the State-respondents, the trial needs to be kept stayed for such period of time as may be required for the purpose of completion of investigation.

Considering, therefore, the matter in its entirety and in the interest of justice, this writ petition is disposed of with direction that trial of Pipra P.S. Case No.21 of 2011, which is pending in the Court of learned Chief Judicial Magistrate, Supaul, shall be resumed, on 03.10.2016, provided that the investigation is, in the meanwhile, completed. If the investigation is not completed within the period aforementioned, the Staterespondents may apply for deferring the trial till such date as may be deemed necessary.
