JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2019 This is an application for grant of anticipatory bail in connection with Shahpur (Karnamepur) P.S. Case No. 264 of 2017, disclosing offences under Sections 341, 323, 498(A), 504, 34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act. Allegation against the petitioner, who happens to be the husband of the informant, is of subjecting his wife to cruelty and harassment with respect to demand of dowry. It further appears from the impugned order that the petitioner has also filed a divorce case against the informant.

Submission of learned counsel for the petitioner is that the allegation is general in nature and no specific allegation has been attributed against him. Further, he has no criminal antecedent.

Having heard both sides, considering that above facts and circumstance of the case and also considering that the petitioner has filed a divorce case against the informant and there is no chance of reconciliation, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court, if possible on the same day.
