The petitioner is in custody in connection with S.T. No. 464 of 2010 arising from Govindganj P.S. Case No. 3 of 2010 registered for offence punishable under Sections 302/34 of the Indian Penal Code.
The petitioner alongwith one other has been charged with assaulting the father of the informant and which injury proved fatal resulting in his death. Since the material on record reflected that a blood stained Daab was held by the petitioner that his prayer was rejected vide order dated 22.2.2012 passed in Criminal Misc. No. 30470 of 2011 again vide order dated 26.3.2014 passed in Cr. Misc. No. 50874 of 2013 and has been renewed through the present application. The order of the court
Patna High Court Cr.Misc. No.21652 of 2015 (2) dt.24-06-2015 below manifests that of the prosecution witnesses, nine have been examined who have supported the occurrence as well as the involvement of the petitioner and only the Investigating Officer and the Doctor are left to be examined.
In the circumstances, no case for indulgence is made out and this application is dismissed.
Since there are only two witnesses left to be examined, the trial court would be well advised to conclude the trial expeditiously.
