JUSTICE PURNENDU SINGH ORAL ORDER 26-10-2021 Heard Sri Nagendra Upadhyay, learned counsel appearing on behalf of petitioner, Sri Ashwani Kumar Tiwari, learned counsel appearing on behalf of O.P. No.2 and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Nokha P.S. Case no. 173 of 2019, registered under Sections 376, 354(B), 341, 323, 379 and 504/34 of the Indian Penal Code.

Pursuant to the order dated 28.02.2020, O.P. No.2 has appeared through her counsel Sri Ashwani Kumar Tiwary and files Vakalatnama on behalf of O.P. No.2 in the Court. Keep it on record.

Both the parties, jointly, prays that matrimonial dispute between the petitioner and O.P. No.2 has been amicably

Patna High Court CR. MISC. No.3108 of 2020(3) dt.26-10-2021 2/2 settled and resolved and they are happily residing together in the matrimonial home. The petitioner states that he has stated in paragraph No.12 that O.P. No.2 was in love affairs with the petitioner and now they are married and living together. Considering the above facts and circumstances and the joint prayer of Sri Nagendra Upadhyay, learned counsel appearing on behalf of petitioner and Sri Ashwani Kumar Tiwari, learned counsel appearing on behalf of O.P. No.2, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Rohtas at Sasaram in connection with Nokha P.S. Case No. 173 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

With the above direction the present petition is disposed.
