Accordingly, petitioner-NVS has made out a prima facie case so as to interfere with the order of the CAT dated 21.10.2021 passed in O.A. No. 050/00339/2021 and it is set aside in the light of order dated 09.01.2023 passed in C.W.J.C. No. 1221 of 2022, insofar as respondent - Raj Kumar Mishra is concerned.
