This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 25(1b)a/26/35 of the Arms Act, registered in connection with Akbarpur P.S.Case No. 544 of 2022.

On some confidential information when the police raided the house of co-accused Navin Singh, who is father of the petitioner, he attempted to close the door of his house hurriedly, but he was arrested. The petitioner, the son of co-accused Navin Singh, was also arrested and a country-made pistol was recovered from his possession.

The learned counsel for the petitioner has submitted that he is innocent and has falsely been implicated in this case. He is a person of clean antecedent and is languishing in jail since 07.10.2022.

Considering the above facts and circumstances, let the

No.4107 of 2023(2) dt.07-04-2023 2/2 petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S.Case No. 544 of 2022, subject to the following conditions:-

1. Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner.

2. The petitioner shall cooperate in the disposal of trial and make available available as and when required by the court.

3. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
