JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-08-2023 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the complainant / opposite party no. 2.
2. The petitioners apprehend their arrest in a case registered for the offence under Sections 323, 467, 468, 471, 420 of the Indian Penal Code.
3. In this case, a supplementary affidavit has been filed on behalf of petitioners and in paragraph - 3 of the same, it
Patna High Court CR. MISC. No.4387 of 2023(8) dt.31-08-2023 2/3 is stated that petitioners are ready to return the amount of Rs. 7,51,000/- (Rupees seven lacs fifty one thousand) in installments in the learned Court below.
4. However, learned counsel for opposite party no. 2 disputes the alleged amount.
5. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Purnea in connection with C.A. Case No. 582 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, in the light of following terms and conditions:
A. At the time of furnishing bail-bond Rs.
1,51,000/- (Rupees one lac fifty one thousand) shall be deposited through Bank Draft.
B. Rest amount i.e. Rs. 6,00,000/- (Rupees six lacs) in six equal installment of Rs. 1,00,000/- (Rupees one lac) within a period of one & half years from the date of furnishing bail-bond.
C. If petitioners fail to comply with the aforesaid direction of this Court, the Court below is free to cancel the bail-bonds of the petitioners.
6. It is made clear that without going into the merit of the case, the aforesaid order has been passed only for the
Patna High Court CR. MISC. No.4387 of 2023(8) dt.31-08-2023 3/3 purpose of bail.
