Raj Kumar Choudhary, learned counsels appearing on behalf of the petitioners and Mr. Ram Bilash Roy Raman, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Jalalpur P.S. Case No. 149 of 2023 dated 22.06.2023 registered for the offence(s) punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.

3. As per the allegation made in the FIR, the accused persons named therein including the petitioners had assaulted the informant and his cousin brothers, who sustained head injury and they also snatched gold chain, worth Rs.50,000/- from the informant.

4. Learned counsel appearing on behalf of the petitioners submitted that petitioners were not involved in the alleged incidence and they have been falsely implicated in the present case. It is further submitted that the specific allegation of assault is against co-accused, Arun Ram, Dharmendra Ram, Manu Ram, Bipin Ram and the injury sustained by the informant / Awadhesh Ray, Umesh Ray and Dinesh Ray is simple in nature.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail and has informed that petitioners have not brought injury report with respect to the informant, which creates suspicion.

Considering the nature of allegation made in the FIR, as well as, the fact that general and omnibus allegation has been made against the petitioners and specific allegation of assault has been alleged against the other co-accused, the petitioners, above named, are directed to be released on prearrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., XIII, Saran, Chhapra in connection with
