JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This application, for grant of anticipatory bail, arises out of Mairwa P.S. Case No. 327/18, disclosing offences under Sections 272, 273, 308 and 34 of the Indian Penal Code and Section 30 (a), 30(d), 38(i) and 38 (ii) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 2 litres of liquor from the house of the petitioner.

Submission of learned counsel for the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered from his house and further he has no criminal antecedent.

Having heard both sides, considering the quantity of recovery as well as the fact that petitioner has no criminal

No.1444 of 2019(2) dt.22-01-2019 2/2 antecedent, as such, Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Siwan, in connection with Mairwa P.S. Case No. 327/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
