In this case, the petitioners are apprehending their arrest in connection with Dhamdaha P.S. Case No. 282 of 2018 registered for offences under sections 366(A) and 34 of the Indian Penal Code.

As per allegation, the accused persons picked up and kidnapped the daughter of the Informant, namely, Nitu Kumari @ Barsa for the purpose of marriage with Pawan Kumar. The petitioner no.1 is the father of Pawan Kumar and petitioner no.2 is the uncle of Pawan Kumar.

It has been submitted that the girl herself has gone

Patna High Court Cr.Misc. No.126 of 2019(2) dt.10-01-2019 2/2 voluntarily with Pawan Kumar and they have entered into marriage placing reliance on the application filed by her giving details of the fact wherein she has stated that she has entered into marriage with Pawan Kumar and is living a peaceful life. Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S. Case No. 282 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
