JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Sessions Trial No. 111 of 2015 arising out of Khaira P.S. Case No. 129 of 2013 in which charges have been framed under sections 413 read with 34 and 414 read with 34 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 28.08.2014 passed in Cr.Misc. No. 27696 of 2014 with an observation that he would be at liberty to renew his prayer for bail after framing of charge. It has been contended that the court below has framed the charges against the petitioner on 1st April, 2015 and till date not a single witness has been examined on behalf of the

Patna High Court Cr.Misc. No.21719 of 2015 (2) dt.13-05-2015 2/2 prosecution. The petitioner is reported to be in custody since 30th December, 2013.

Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Saran at Chapra in connection with Sessions Trial No. 111 of 2015 arising out of Khaira P.S. Case No. 129 of 2013.
