This application for grant of regular bail arise out of Desri P.S. Case No. 172 of 2022, registered for the offence punishable under Sections 393, 394, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution, informant along with his brother were going to village Sahariya on a motorcycle by closing their shop. On way, three miscreants armed with pistol riding on a motorcycle stopped them and on gun point and shot informant brother and fled away. During treatment, informant brother died. And on aforesaid fact, the F.I.R. was instituted on 23.04.2022. Petitioner is accused in three more cases In view of the aforesaid fact, this Court is not inclined

Patna High Court CR. MISC. No.6933 of 2023(2) dt.16-05-2023 2/2 to grant bail to the petitioner.

Accordingly, the prayer of bail of the petitioner is rejected herewith.

The District Judge, Hajipur at Vaishali is directed to expedite the trial of all the cases pending against the petitioner. The Senior Superintendent of Police, Hajipur at Vaishali is also directed to cooperate in the disposal of the trial and sent a report of the trial within six months as directed by this Court.

Let a copy of this order be communicated to District Judge, Hajipur at Vaishali and Superintendent of Police, Hajipur at Vaishali for its forthwith compliance.
