The petitioner being the husband of the informant is languishing in custody since 17.02.2016 in a case registered for the offences punishable under sections 498A/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that the petitioner had filed Matrimonial Suit No.863/2013 with a prayer for annulment of marriage and thereafter, the present case has been filed.

It is submitted by learned counsel for the informant that the petitioner performed love marriage with the informant.

Patna High Court Cr.Misc. No.13232 of 2016 (2) dt.06-04-2016 2/2 Considering the nature of accusation and filing of matrimonial suit at earlier point of time, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur, in connection with Naubatpur P.S. Case No.416/2013.
