The petitioner is languishing in custody since 11.10.2014 in a case registered for the offences punishable under Sections 376, 384, 498A, 504, 506/34 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. It is alleged that when the informant was 17 years old the petitioner being married person ravished her. The petitioner married with the informant on 13.01.2013 in a temple. The petitioner took her to Surat to his sister's house and kept her. Subsequently the petitioner deserted the informant. It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the informant has got her
Patna High Court Cr.Misc. No.22468 of 2015 (2) dt.13-07-2015 2/2 age recorded as 25 years meaning thereby she was alleged to have been ravished eight years prior to the lodging of the case. It is submitted by learned counsel for the informant that he is not opposing the prayer for bail of the petitioner on the basis of the compromise petition filed by the petitioner, though the counsel for the petitioner denies the factum of compromise.
Considering the fact that the investigation has already concluded and the informant is not opposing the prayer for bail of the petitioner, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Bihta P.S.
