Mr. Md. Aslam Ansari ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 14-02-2025
1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 447, 341, 342, 323, 324, 307, 302 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner had earlier moved this Court seeking regular bail by filing Cr. Misc. No.82015/2024, which was permitted to be withdrawn by an order dated 11.12.2024 with liberty to the petitioner to renew his prayer for bail after framing of charge. The learned counsel next submits that it appears that inadvertently when Cr. Misc. No.82015/2024 was taken up relevant submission was not made that charges against the petitioner stands framed on 12.08.2024. It is thus submitted that
Patna High Court CR. MISC. No.5421 of 2025(2) dt.14-02-2025 2/3 charges against the petitioner has been framed and the petitioner if granted the privilege of bail will not abscond rather will cooperate in the trial to prove his innocence.
4. Learned A.P.P. opposes the prayer for bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.25000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Manigachi (Bajidpur O.P.) P.S. Case No.128/2021.
6. Further, one of the bailors of the petitioner shall be his father, namely, Md. Safikur Rahman @ Chathru.
7. It is made clear that if the learned trial court comes to a conclusion that petitioner after his release is trying to delay the trial in any manner, in that event, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
8. The learned counsel for the petitioner at this stage submits that he may be permitted to rectify the name of the father of the petitioner as Md. Safikur Rahman @ Chathru since the petitioner has been described as son of Md. Satikur Rahman.
