2. The petitioner seeks bail in connection with Bihariganj P.S. Case No. 151 of 2023 registered for the offence punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, one Pappu Mandal is said to have killed the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case.

5. The petitioner has been named in the confessional statement of Pappu Mandal. The petitioner is in jail since 23.07.2023 having clean antecedent.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Uda-Kishunganj in connection with Bihariganj P.S.
