JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The informant is not an eye witness of the alleged occurrence. Moreover, the impugned order shows that petitioner and co-accused were seen in the company of the deceased prior to the alleged occurrence and except the aforesaid circumstance, there appears to be nothing against the petitioner. The co-accused, Pankaj Harijan @ Pankaj Das and Mahesh Harijan @ Mahesh Das, having more or less similar allegation, have already been granted privilege of bail by a co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.14927 of 2016 (2) dt.11-04-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 5th Additional Sessions Judge, Banka in connection with Sessions Case No. 338 of 2015 arising out of Amarpur P.S. Case No. 197 of 2015.
