JUSTICE PARTHA SARTHY ORAL ORDER 09-07-2021 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Khagaul P.S. Case no. 89 of 2020 registered against unknown under sections 392 and 34 of the Indian Penal Code.

As per allegation in the FIR, four accused persons on two motorcycles overtook and forced the car of the informant to stop. On the point of gun, the informant was dispossessed of Rs. 17000/-, the car and other articles.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused Bhushan Kumar. No incriminating article has been recovered from the possession of the petitioner. Inspite of being in custody since 20.8.2020 and charge sheet having been submitted, the petitioner has not been put on TI Parade. The aforesaid Bhushan Kumar has been enlarged on bail vide order dated 24.6.2021

Patna High Court CR. MISC. No.13725 of 2021(4) dt.09-07-2021 2/2 passed in Cr. Misc. no. 8583 of 2021.

The application for bail is opposed by learned counsel for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with grant of bail to co-accused, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Khagaul P.S. Case no. 89 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Danapur, Patna.
