Petitioner seeks bail in a case registered under sections 399, 402, 414 of the Indian Penal Code as well as sections 25 (I-b)a, 26, 35 of the Arms Act.

Petitioner and several other co- accused were caught on the spot and firearms were recovered from conscious possession of other accused whereas only a magazine containing seven live cartridges is said to have been recovered from conscious possession of the petitioner for which the petitioner is in jai custody since 17.1.2016 without having any criminal antecedent.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Barhara P.S. Case no. 15/2016.
