The appellants have challenged the order dated 09.10.2021 passed by the learned Additional Sessions Judge-I-cum-Special Judge, SC/ST Act, Purnia in connection with K. Hat (Maranga) P.S. Case No. 658 of 2021 instituted for the offences punishable under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code and Section 3(1)(r)(i)/3(2)(v) of the SC & ST (Prevention of Atrocities) Act, 1989, whereby their prayer for being released on anticipatory bail has been

The accusations are of snatching golden chain and cash of the informant and abusing him by calling his caste name.

It is submitted by learned counsel for the appellants that appellants have falsely been implicated in this case and in the background of dispute with regard to panchayat election, the present case has been lodged. Moreover, the parties have entered into compromise. A statement has been made in para 3 of the petition that appellants have no criminal antecedent.

Taking into account the aforesaid facts, this Court deems it appropriate to set aside the order dated 09.10.2021 passed by the learned Additional Sessions Judge-I-cum-Special Judge, SC/ST Act, Purnia. Accordingly, this appeal is allowed.
