In this case, the petitioner is apprehending her arrest in connection with Riga P.S. Case No. 282 of 2018 registered for offences under sections 272/273 of the Indian Penal Code and Section 30 (A) of the Bihar Prohibition and Excise Act, 2016.

There is a recovery of 8 liters of Nepali Saufi wine from the back side of the house of the petitioner. Learned counsel for the petitioner submits that the house is a joint family house and, thus, the petitioner cannot be implicated in the present case and, at the same time, the petitioner is a female.

Looking to the entire facts and circumstances of the

No.131 of 2019(2) dt.10-01-2019 2/2 case, let the petitioner, namely, Niranjan Devi, in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge II, Sitamarhi cum Special Judge Excise Act, Sitamarhi in connection with Riga P.S. Case No. 282 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, she will remain present and if she would not present herself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
