Petitioner is in custody in connection with Darbhanag Sadar P.S. Case No. 29 of 2019 for the offence under sections 30(a)/34(a) of Bihar Prohibition and Excise Act, 2016 and 420 of the Indian Penal Code.

In the instant case total 20 liters of liquor was seized. Learned counsel for the petitioner submits that the alleged liquor was seized from a bush and not from the conscious possession of the petitioner The petitioner is in custody since 23.11.2019. Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined
