The petitioner seeks bail in anticipation of his arrest in connection with Bajpatti P.S. Case No. 169 of 2020 instituted for the offences under Sections 147, 341, 323, 324, 307, 379, 354(B), 436, 427, 504 and 506/34 of the Indian Penal Code.
Several persons have been made accused in this case and there is an accusation of assault and taking away of food-grains.
It has been submitted on behalf of the petitioner that there is nothing on record to indicate causing of any
Patna High Court CR. MISC. No.15345 of 2021(2) dt.04-01-2022 2/2 injury on any one of the victims so as to warrant the prosecution of the petitioner and others under Section 307 of the I.P.C. It has further been submitted that the parties are neighbours.
Considering the general nature of accusation against 21 accused persons including the petitioner, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Pupri at Sitamarhi in connection with Bajpatti P.S. Case No. 169 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
