On getting confidential information regarding habitual dealing with stolen property more particularly motorcycles, a raid was conducted and during said course, three persons were apprehended, namely, Sharma Prasad, Sabba Karim (petitioner) as well as Rohit Kumar. A motorcycle was also found there. On query Sharma Prasad confessed his guilt and further disclosed with regard to his activity in getting stolen motorcycle sold to different persons and during course thereof, it is also apparent that negotiation was going on in between Sharma Prasad as well as Sabba Karim and for that they have assembled there. Accordingly, seizure list was prepared and petitioner including others have been booked on account thereof, is under custody since 02.03.2015.
Furthermore, as per para-3 there happens to be absence of criminal antecedent.
Patna High Court Cr.Misc. No.21906 of 2015 (2) dt.07-07-2015 In the aforesaid facts and circumstances of the case, petitioner Sabba Karim is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of Sri R. Kumar-IVth, Judicial Magistrate, 1st Class, East Champaran at Motihari in connection with Kotwa P.S. Case No.38 of 2015. (Aditya Kumar Trivedi, J.) PN/- U T
