The petitioner seeks bail in Budha Colony P.S.Case No. 251 of 2014 registered under Sections 302, 201, 120B and34l IPC. The informant Prabhakar Samdarsi @ Suraj suspected the hands of Upendra Choudhary, Sushakti Jha, Rakesh Jha, Manish Singh, Randhir Kumar, Ravi Kumar and other accused persons in killing of deceased Mamta Devi. It is alleged that Upendra Choudhary had taken money from Mamta Devi for providing job.

From the possession of the petitioner, T-shirt was recovered. A person was wearing the same colour T-Shirt at the time of crime. It is alleged that the petitioner was moving around wearing the same T-shirt. The Investigating Officer found the involvement of the petitioner on the basis of call details but it appears that from the possession of the petitioner mobile no.9155030463 was recovered. The petitioner is said to have disclosed that he was having the mobile of Chandrama Singh bearing no.7677845494l from which had made call to the Mobile

Patna High Court Cr.Misc. No.3886 of 2015 (5) dt.04-05-2015 2/2 of Mamta Devi bearing No.778285233 but the Investigating Officer has not collected any material to show the petitioner's involvement in the case except confessional statement. Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar Bharti, Judicial Magistrate, Ist Class, Patna in connection with Budha Colony P.S.Case No.251 of 2014.
